These terms of service (“Terms of Service”) set forth the terms and conditions that apply to your use of Alda Bejdo’s website, located at https://www.itsyourvibe.ca (“Website”), and any and all affiliated websites, webpages, social media channels, and/or accounts, including, without limitation, those which may be found on Facebook, Twitter, LinkedIn, TikTok, YouTube, or otherwise (the Website, affiliated websites, servers, social media channels and/or accounts, collectively, the “Platforms”).

Alda Bejdo may change these Terms of Service from time to time, at Alda Bejdo’s sole discretion, without notice to you. You are encouraged to check for updates each time you visit or use the Platforms to review the then-current terms. Your continued use of the Website and the Platforms signifies your acceptance of these Terms of Service.

Use of the Platforms is restricted to your personal use and you shall not use the Platforms for any other purpose.

c) is or is connected with a chain letter or pyramid scheme; or

d) contains a virus, trojan horse, worm, time bomb or other computer programming routine or engine that is intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information.

The Website and the Platforms are not intended for persons under the age of 13 and Alda Bejdo does not knowingly collect personal information from children in this age group.

Alda Bejdo owns (or has the right to use) all content on the Platforms and all intellectual property rights therein, and all such content is protected under copyright law.

Alda Bejdo and any current or future affiliated or related company or brand (collectively, “Affiliates”) trademarks and design marks (collectively, the "Marks") are trademarks or registered trademarks of Alda Bejdo and/or its Affiliates, and the property thereof. All other product, brand, and company names and logos used, displayed, or referenced on the Platforms may be the trademarks or registered trademarks of their respective owners. Any use of any trademarks, including the Marks, without the express written consent of the owner of the trademark is strictly prohibited.

Alda Bejdo specifically disclaims all warranties and conditions of any kind including, but not limited to, all implied warranties and conditions of merchantability, fitness for a particular purpose, title, and non-infringement.

ANTI-SPAM

Alda Bejdo does not use the Platforms to disseminate spam. E-mail messages sent in connection with the Platforms, such as Alda Bejdo’s email newsletter, are only sent to those who have provided express or implied consent therefor and will contain an “unsubscribe” link.

GOVERNING LAW

The Website and the Platforms are controlled and operated by Alda Bejdo from Toronto, Ontario, Canada. You agree that your use of the Platforms is governed by the laws of the Province of Ontario and the federal laws of Canada without giving effect to any principles of conflict of law. Alda Bejdo has made all reasonable attempts to comply with all legal requirements known to her in creating and maintaining the Platforms, but makes no representation that any materials or content on the Platforms are necessarily acceptable, appropriate, or available in any jurisdiction. If you choose to access the Platforms from any location other than Canada, you do so of your own volition and you are solely responsible for complying with any applicable local laws. If any part of these Terms of Service is invalid or unenforceable for any reason whatsoever under applicable law, the invalid or unenforceable provision shall be deemed severable from these Terms of Service and shall not affect the validity or enforceability of any remaining provisions.

INJUNCTIVE RELIEF AND PROVISIONAL RELIEF

Alda Bejdo shall have the right to seek and obtain any injunctive, provisional, or interim relief from any court of competent jurisdiction to protect its trademark or other intellectual property rights or confidential information.

CONSENT TO USE OF ELECTRONIC DOCUMENTS

You hereby consent to the exchange of information and documents between you and Alda Bejdo over the Internet or by e-mail, and that any such agreement in electronic form shall be the equivalent of an original written paper agreement. You further agree that all agreements, notices, disclosures, and other communications that Alda Bejdo provide to you electronically satisfy any legal requirement that such communications be in writing.
